Rules for the purchase and sale of goods
1. General provisions
1.1. These rules of the online store (hereinafter – Rules) are a legally binding document for the Buyer and the Seller (hereinafter – Seller), which establishes the rights and obligations of the Parties.
1.2. The Seller reserves the right to change, amend, or supplement these Rules at any time. The Buyer is informed of changes to the Rules on the online store's website.
2. Conclusion of the Purchase-Sale Agreement
2.1. The Purchase-Sale Agreement between the Buyer and the Seller is considered concluded when the Buyer forms and submits an order for goods in the online store after familiarizing themselves with these rules.
3. Seller's rights
3.1. In the event of significant circumstances, the Seller may temporarily or completely suspend the operation of the online store without prior notice to the Buyer.
3.2. If the Buyer attempts to harm the operation, stability, and security of the online store or violates their obligations, the Seller has the right to restrict or suspend their ability to use the online store without warning.
4. Seller's obligations
4.1. The Seller undertakes to provide the opportunity to use the services of the online store, the operating conditions of which are determined by these Rules.
4.2. The Seller undertakes to deliver the goods purchased by the Buyer using the delivery method chosen by the Buyer, based on the conditions set by these purchase – sale Rules.
4.3. Due to unforeseen circumstances, the Seller cannot deliver the goods ordered in the online store; the Seller has the right to terminate the Purchase-Sale Agreement after informing the buyer. The Seller may offer a similar product. If the buyer refuses, the Seller is obliged to refund the paid money within 3 working days.
4.4. If the Buyer exercises the right provided in point 5.2 of the Rules, the Seller is obliged to refund the amount paid by the Buyer within 5 (five) working days from the date of receipt of the returned goods.
4.5. The Seller may not refund the amount paid by the Buyer until the goods are returned to the Seller or until the Buyer provides proof that the goods have been sent to the Seller, whichever occurs first.
5. Buyer's Rights
5.1. The Buyer has the right to purchase goods in the online store in accordance with these Rules.
5.2. The Buyer has the right to withdraw from the purchase-sale agreement made in the online store by notifying the Seller in writing no later than 14 (fourteen) calendar days from the date of delivery of the goods.
5.3. The right of the Buyer discussed in point 5.2 can only be exercised if the goods have not been damaged or their appearance has not fundamentally changed, and if they have not been used.
6. Buyer's Obligations
6.1. The Buyer must pay for the purchased goods and accept them in accordance with the procedures specified in these Rules.
6.2. If the Buyer refuses to accept the goods during delivery without valid reasons, at the Seller's request, the Buyer must cover the costs of returning the goods.
6.3. During the delivery of goods to the Buyer, the Buyer must check the condition of the package and the goods with the Seller or the person who delivered the package.
6.4. The Buyer, using the online store, confirms that they agree to these purchase – sale rules and must comply with them.
7. Prices of Goods
7.1. The prices of goods in the online store are indicated in euros. Prices are stated including VAT. Upon confirming the order, a delivery fee is added to the total amount of goods if applicable.
8. Ordering and Payment for Goods
8.1. The Buyer, upon visiting the online store, selects the goods they like and adds them to the shopping cart. After forming the shopping cart, the Buyer enters personal data necessary for order fulfillment: their first name, last name, address where the goods will be delivered, phone number, and additional information that may be important for delivering the ordered goods. The Buyer confirms that they have read these rules and confirms the order.
8.3. Payment can be made using Swed, Seb, Luminor, Citadel, Šiaulių bank electronic banking services, as well as Visa / MasterCard payment cards. Payments can be made in euros. Payments are processed using MakeCommerce.lt payment platform.
9. Delivery of Goods
9.1. The Buyer, when ordering goods, must specify the exact delivery address of the goods.
9.2. The Buyer must accept the goods personally. If the Buyer cannot accept the goods personally, but the goods are delivered to the address specified by the Buyer, the Buyer has no right to make claims regarding the delivered goods to an inappropriate person.
9.3. The Seller delivers the goods to the Buyer in accordance with the terms specified in the product descriptions.
9.4. The characteristics of all sold goods are specified in the description accompanying each product. The Seller is not responsible for the fact that the color, shape, or other parameters of the goods in the online store may not match the actual size, shape, and color of the goods due to the characteristics of the monitor used by the Buyer.
9.5. If the Buyer refuses the purchase-sale agreement, all amounts paid by the Buyer, including the delivery costs paid by the Buyer, shall be refunded.
10. Return of goods
10.1. Quality goods can be returned within 14 days from the date of receipt. Defects in sold goods of inadequate quality are remedied, and inadequate quality goods are exchanged or returned in accordance with the provisions of the Civil Code of the Republic of Lithuania.
10.2. When returning goods, the following conditions must be met:
10.2.1. The returned goods must be in their original tidy packaging (this clause does not apply if the returned goods are of inadequate quality);
10.2.2. The goods must be undamaged by the Buyer;
10.2.3. The goods must be unused, retaining their commercial appearance: undamaged labels, unpeeled protective films, etc. (this clause does not apply if the returned goods are of inadequate quality);
10.2.4. The returned goods must be of the same configuration as those received by the Buyer (this clause does not apply if the returned goods are of inadequate quality);
10.2.5. The Seller has the right to refuse to accept the goods returned by the Buyer if the conditions for the return of goods have not been met;
10.2.6. The return of goods shall be carried out in the manner specified by the Seller within 14 (fourteen) days from the date of receipt of the goods (this clause does not apply if the goods are of inadequate quality - in such cases, the return of goods is carried out within the statutory warranty period);
10.3. The return and exchange of goods of appropriate quality shall be carried out in accordance with Article 6.22810, Part 1 of the Civil Code;
10.4. Money paid for goods accepted by the Buyer but later rejected shall be refunded to the Buyer's account no later than 5 (five) days from the date of return of the goods to the Seller, unless otherwise agreed by the Seller and the Buyer.
11. Final provisions
11.1. These Rules are established in accordance with the legal acts of the Republic of Lithuania.
11.2. These Rules and the relationships between the parties in relation to these Rules shall be governed and interpreted in accordance with the laws of the Republic of Lithuania.
11.3. All disputes arising from the execution of these Rules shall be resolved through negotiations. If an agreement cannot be reached, disputes shall be resolved in accordance with the laws of the Republic of Lithuania.
11.4. The parties are released from their obligations under these Rules if they cannot be fulfilled due to unforeseen circumstances beyond the control of the parties (Force major).
